The Case

The controversy began with ads that appeared in major Karnataka newspapers on May 5, 2023. These ads, titled “Corruption rate card,” accused the BJP’s Basavaraj Bommai-led government of being a “40 per cent Commission Sarkara (government),” suggesting widespread corruption. In response, the BJP filed a complaint in June 2023, claiming the ads made false and defamatory statements.

The Karnataka Pradesh Congress Committee, led by its president Shivakumar and then-Leader of the Opposition Siddaramaiah, issued these ads. Rahul Gandhi shared these advertisements on his social media account on X (formerly Twitter), further amplifying the accusations.

Court Appearances and Bail to Rahul Gandhi

On June 1, 2024, Siddaramaiah and Shivakumar appeared in court and were granted bail. The court scheduled June 7 for Rahul Gandhi’s personal appearance. Despite his counsel’s request for an exemption, which the complainants opposed, Gandhi attended the hearing as required.

At the hearing, the judge granted Rahul Gandhi bail, allowing him to continue his political activities without immediate detention.

In a related development, another court case involving Rahul Gandhi was postponed. An MP-MLA court in Prayagraj delayed the hearing of a 2018 defamation case concerning Gandhi’s remarks about Union Home Minister Amit Shah. The hearing was rescheduled to June 18 due to the death of a lawyer involved in the case. This case, filed by BJP leader Vijay Mishra, stems from comments Gandhi made in May 2018 during a press conference in Bengaluru, where he alleged that the BJP president was involved in a murder case. Amit Shah had been discharged from the 2005 fake encounter case by a special CBI court in 2014.
